Terms of Service

These Terms of Service ("Terms") are an agreement between you and YourEDU, Inc. ("YourEDU," "we," "us") governing your use of our websites and services (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services.

A "Community" is a homeschool group, co-op, microschool, or other organization that uses YourEDU to run its programs.

• Account holders must be 18 or older. Parent, guardian, teacher, and administrator accounts may only be created by adults.
• Student accounts are created only by parent invitation. A student of any age may use the Services only through an account their parent or guardian creates by invitation. The parent accepts these Terms on the student's behalf, consents to the Student & Children's Privacy Notice, and is responsible for the student's use of the Services.
• Accurate information. You agree to provide accurate information and keep it current. Where a Community's programs rely on information you provide — such as a student's medical or emergency information — keeping it accurate is your responsibility.
• Account security. You are responsible for safeguarding your login credentials and for activity under your account. Tell us promptly at support@youredu.com if you suspect unauthorized access.
• Roles. Administrators and teachers may access member and student information only as needed for their role in their Community, and must use it solely for that Community's educational operations.
• FERPA school official. If a Community or school subject to the Family Educational Rights and Privacy Act (FERPA) uses the Services, YourEDU operates as a "school official" with a legitimate educational interest: the organization retains direct control over its education records, we use them only to provide the Services, and we do not re-disclose them.

Joining a Community is optional — many families use YourEDU on their own, and this section applies only if you join one.

Communities are independent organizations. They are not owned, operated, or supervised by YourEDU, and YourEDU is not a school. Your Community — not YourEDU — is responsible for its programs, instruction, events, supervision of students, admissions and enrollment decisions, conduct policies, and its own compliance with laws that apply to it. Your Community also sets its own fees and refund policies for its programs.

• Processing. Payments are processed by Stripe. By making a payment you also agree to Stripe's applicable terms. Fees for programs, memberships, and events, along with any platform or processing fees, are shown before you pay.
• YourEDU as limited payments agent. When you pay a Community through the Services, YourEDU acts as the Community's limited agent for receiving payment. Your payment obligation to the Community for the amount paid is satisfied when YourEDU (through Stripe) receives your payment, even if the Community later disputes its settlement with YourEDU.
• Saved payment methods and scheduled charges. If you enroll in a payment plan or authorize scheduled charges, you authorize us to charge your saved payment method on the disclosed schedule until the plan is complete or canceled per its terms. You'll receive reminders and receipts by email.
• Refunds. Refunds for a Community's programs are governed by that Community's refund policy. YourEDU facilitates refunds the Community approves.
• Failed payments. If a charge fails, we may retry it and notify you. Communities may suspend program access for unpaid balances under their own policies.

You (or your Community) own the content you submit to the Services — course materials, records, documents, photos, posts, and coursework ("User Content"). You grant YourEDU a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and transmit User Content solely to operate, provide, and improve the Services and as directed by you or your Community (for example, publishing content a Community chooses to put on its public page). This license ends when the content is deleted, except for copies in routine backups pending purge and records we must keep by law.

You are responsible for having the rights to the content you submit, including permission to upload photos of others.

Some tools use artificial intelligence to help generate drafts. AI output may be inaccurate or incomplete — review it before relying on it or presenting it to others. You are responsible for content you adopt from AI tools. Content you submit to AI features is handled as described in the Privacy Policy and is not used to train AI models.

You agree not to:

• Break the law, infringe others' rights, or misuse anyone's personal information — including accessing or using member or student information beyond your role;
• Harass, threaten, or harm others, or post content that is abusive, obscene, or endangers a minor;
• Impersonate others, misrepresent an affiliation, or create accounts with false information;
• Attempt to probe, breach, or disrupt the Services' security, scrape the Services, or access data not intended for you;
• Use the Services to send spam or unauthorized solicitations;
• Resell or white-label the Services without our written agreement.

We may remove content or suspend accounts that violate these Terms, with notice where practicable.

The Services — including software, design, and content we provide (excluding User Content) — are owned by YourEDU or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services per these Terms. Don't copy, modify, or create derivative works of the Services except as allowed by law.

Copyright complaints (DMCA)

We respect copyright and expect users to do the same. If you believe content on the Services infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to our designated agent at support@youredu.com (Copyright Agent, YourEDU, Inc., 2627 Hanover St, Palo Alto, CA 94304; (646) 946-6198), including: identification of the copyrighted work and of the allegedly infringing material, your contact information, a statement of your good-faith belief that the use is unauthorized, a statement that your notice is accurate under penalty of perjury, and your physical or electronic signature. We will remove or disable access to material identified in a valid notice and notify the user who posted it, who may submit a counter-notice under § 512(g). We terminate the accounts of repeat infringers in appropriate circumstances.

Our Privacy Policy and, for student accounts, the Student & Children's Privacy Notice describe how we collect, use, and protect personal information. They are part of these Terms.

The Services rely on third-party providers (such as Stripe for payments and hosting/email providers). We are not responsible for third-party services we don't control, though we choose providers bound to safeguard your information as described in the Privacy Policy.

• By you — you may stop using the Services and delete your account at any time from account settings. Export records you want to keep (such as transcripts) before deleting.
• By us — we may suspend or terminate accounts that violate these Terms, create risk for other users, or where required by law. Where practicable we will give notice and a chance to cure.
• Effect — on termination, your license to use the Services ends and your information is handled per the Privacy Policy's retention terms. Sections that by their nature survive (including Sections 5 and 12–15) survive termination.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, YOUREDU DOES NOT WARRANT ANY EDUCATIONAL OUTCOME, AND IS NOT RESPONSIBLE FOR THE PROGRAMS, INSTRUCTION, EVENTS, OR CONDUCT OF COMMUNITIES OR THEIR MEMBERS (SECTION 3). SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

The Services include tools that help families prepare homeschool compliance documents (such as state filings). These tools are provided for convenience and are not legal advice; your family remains responsible for meeting the homeschool requirements of your state.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUREDU WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL. YOUREDU'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO YOUREDU FOR USE OF THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AND (B) $100. THIS LIMIT DOES NOT APPLY TO LOSSES CAUSED BY YOUREDU'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR TO LIABILITY THAT CANNOT BE LIMITED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

You agree to indemnify and hold YourEDU harmless from claims arising out of your violation of these Terms, your User Content, or your misuse of the Services, to the extent permitted by law.

• Severability. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary — or severed if it cannot be modified — and the remaining provisions stay in full effect.
• Entire agreement. These Terms, together with the policies they reference, are the entire agreement between you and YourEDU about the Services and supersede prior agreements on that subject.
• Assignment. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Waiver. Our not enforcing a provision is not a waiver of our right to enforce it later.
• Notices. We may give you notice by email to your account address or within the Services; legal notices to us go to the contact in Section 17.
• Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
• U.S. use. The Services are operated from the United States and intended for users in the United States; we make no representation that they are appropriate for use elsewhere.

We may update these Terms as the Services evolve. For material changes we will give advance notice (for example, by email or in-product notice), and the changes will apply prospectively from the stated effective date. Continuing to use the Services after that date means you accept the updated Terms.
